Summary of Today’s Announcement
Monday, Nov 18th, 2019 marks yet another historic announcement by the Trump Administration. Secretary of State Pompeo announced a policy clarification regarding the legality of Israeli communities in Judea and Samara by stating that; “They are no longer deemed illegal.”
Pompeo’s announcement was the conclusion of a year-long review conducted by the State Department’s legal office. Their verdict of findings was that; “The establishment of Israeli civilian settlements is not, per se, inconsistent with international law.”
This decisive ruling had eluded and frustrated US Governments for years. The WH position halted between the opinions of Democrats as embodied in President Jimmy Carter who in 1978 stated that “…settlements were not consistent with international law…”. This was subsequently overturned by Republican President Ronald Reagan in 1981 who stated that he “…did not view them as inherently illegal.” Not to be outdone, in December of 2016 with only days left in his term, former Democratic President Obama issued a memo not to use the American veto to stop the United Nations Security Council’s passage of Resolution 2334 that condemned Jewish communities in Judea and Samaria as “flagrant violation[s]” of international law”.
That UN resolution was widely regarded as lacking the “legal validity” of previous UN declarations including legislation dating back to the British Mandate and before concerning Jewish rights to their historic homeland.
Today’s announcement by the Trump Administration was an extraordinary “roll-back” of one of Obama’s last decrees in office.
PM Netanyahu congratulated the Trump Administration with this response; “This policy reflects a historical truth — that the Jewish people are not foreign colonialists in Judea and Samaria,” he continued. “In fact, we are called Jews because we are the people of Judea.”
